Regulator Engagement
Direct Regulator Engagement on Your Behalf
When guidance conflicts or a requirement is unclear, ORBIS engages the regulatory authority directly to settle the path, resolve disputes, and prevent unnecessary testing and application work.
Two advisors disagree. A public AI offers a third answer. The regulator has the only one that counts.
The situation
The most expensive words in compliance are 'to be safe.'
A laboratory says a product needs a full retest for a new market. A consultant says the existing report is fine. The compliance team, unable to resolve it and unwilling to risk the launch, orders the retest. Weeks and a large invoice later the certificate arrives, and nobody ever finds out the regulator would have accepted the original report. Multiply that across a portfolio and a market footprint and it's one of the largest hidden costs in global compliance.
The alternative is to ask. Regulatory authorities have positions on how their requirements apply, and most will share them when asked properly, by someone who understands the regulation and can describe the product precisely. Getting that reading settles the question, protects the decision, and frequently removes work no one actually required.
ORBIS Compliance engages regulators directly, on your behalf, as a core part of how we work. It's one of the reasons manufacturers choose a Legal & Engineering Global Regulatory Advisory over a marketplace, a lab, or a software tool. Those can quote an approval. They can't have the conversation that decides whether it's needed.
When we engage
Situations where a regulator conversation is the right move
Conflicting guidance
Laboratories, certification bodies, or consultants disagree on applicability or method. The authority's reading resolves it without defensive testing.
Ambiguous requirements
The published text doesn't clearly cover your product's configuration, technology, or use case. A clarification request settles how it applies.
Novel products
Your product doesn't fit an existing category, or combines several. Engaging early establishes the path rather than discovering it at customs.
Enforcement questions
A requirement exists on paper but its enforcement practice is unclear. Knowing what the authority actually expects prevents both over- and under-compliance.
Held shipments and challenges
Customs or market surveillance has questioned a product. Direct engagement with the evidence in hand resolves it faster than a chain of intermediaries.
Unverified answers
A confident answer from a public AI tool or an unnamed source is driving a decision. Before acting on it, we confirm it with the authority.
How ORBIS does it
Respectful, precise, and documented.
Regulators are the destination, never the adversary. Effective engagement treats them that way. Our regulatory professionals frame the question precisely, describe the product accurately, and ground the request in the regulation's own text and purpose. The aim is a clear answer the authority is comfortable giving, not a debate.
The answer becomes part of your file. A written clarification from the regulator is stronger evidence than any consultant's opinion, and it lives in your product record in ORBIS Intelligent Compliance where your team, and the laboratories and certification bodies working on the product, can rely on it. If the same question comes up in a later project, the answer is already there with its date and source.
Where the issue is bigger than one product, such as a draft rule that would block a category or a standard referencing a test no local lab can perform, engagement moves into our government advocacy practice: consultation responses, standards participation, and coordinated industry positions.
The principle
Fight the idea of Fragmented Compliance, not the regulators.
Conflicting opinions, disconnected tools, and unverified answers are the problem. The authority is where the problem gets solved.
Questions
Regulator engagement
Won't asking the regulator slow things down?
+
Sometimes a clarification takes a few weeks. A retest takes longer and costs more, and a wrong guess can cost the launch. We assess each case: when the answer is clear from the text, we don't ask. When it isn't and the stakes justify it, asking is the fast path.
Can ORBIS engage regulators in any country?
+
We engage authorities directly across the markets where our legal and engineering team works, and through vetted local partners where a market requires in-country representation for the conversation. We're transparent about which route applies.
What if the regulator's answer isn't what we hoped?
+
Then you have a reliable answer, early, and can plan around it instead of discovering it at customs. Sometimes the answer also opens a route to advocacy if the requirement is unworkable. Either way, a known requirement is cheaper than an unknown one.
Stop guessing. Ask the authority.
Tell us the requirement in question, the product, and the answers you've been given so far. We'll assess whether a regulator conversation will settle it, and if so, we'll have it.
