Packaging Compliance and Producer Responsibility

Packaging material restrictions, recyclability and design rules, labeling and recycling codes, and packaging producer responsibility registration and reporting across every market you ship into.

The category

Packaging is regulated independently of what's inside it, in nearly every market, and the rules are tightening fast.

The regulatory position

Material, design, labeling, and producer responsibility, each with its own rules per country.

Packaging compliance has four dimensions. Material restrictions limit heavy metals and other substances in packaging components, inks, and coatings. Design and recyclability rules, led by the EU's Packaging and Packaging Waste Regulation, increasingly require packaging to be recyclable, minimize empty space, and meet recycled content targets. Labeling rules mandate recycling codes, material identification, and sorting instructions, with several countries requiring specific national symbols and others prohibiting symbols that could mislead. And producer responsibility requires companies placing packaged goods on the market to register, report the packaging they put out, and finance its collection and recycling through fees or schemes.

These rules apply to the packaging around any product, whether the product itself is regulated or not. A manufacturer of electronics, cosmetics, toys, or food all carries packaging obligations in every market, in addition to their product obligations. The rules are national, sometimes regional, and they change frequently as governments pursue waste reduction targets. Packaging that's compliant in one market can carry a prohibited symbol in another, or trigger a registration nobody knew about.

ORBIS Compliance manages packaging compliance for manufacturers and brands alongside their product compliance: material and labeling review, producer registration and scheme membership, reporting, and monitoring of the packaging rules that keep moving.

The four dimensions

What packaging is regulated for

  • 01

    Material restrictions

Heavy metal limits in packaging and components under EU, US state, and national rules, plus substance restrictions on inks, coatings, and adhesives, and food-contact rules where relevant.

  • 02

    Design and recyclability

Recyclability requirements, minimization rules, recycled content targets, and restrictions on specific formats and materials under the EU PPWR and national laws.

  • 03

    Labeling and marking

Material identification codes, national sorting and recycling labels, and rules on which environmental symbols may or must appear, differing sharply by market.

  • 04

    Producer responsibility

Registration, quantity reporting by material, fees modulated by recyclability, and scheme membership in each market where you place packaged goods.

Producer responsibility for packaging

The obligation that applies to every company and gets missed by most.

Packaging producer responsibility is the broadest EPR regime in the world. It covers the sales packaging, grouped packaging, and transport packaging around goods placed on a market, and it applies to the company legally placing them there: the manufacturer, the importer, or in some frameworks the brand owner or the online seller. Thresholds are low or nonexistent in many markets. Fees are increasingly modulated by material and recyclability, so packaging design decisions have a direct cost.

Because it belongs to no one department, it's frequently discovered late: through a scheme's back-billing, an authority's inquiry, a marketplace's onboarding requirement, or a customer's audit. By then several years of unregistered volumes may be owed.

ORBIS maps packaging producer obligations for each market you ship into, determines who in your supply chain holds them, handles registration and scheme membership, and builds the reporting on one data model so quantities by material are produced for each scheme from the same shipment records. The program lives in ORBIS Intelligent Compliance alongside your product and other environmental obligations.

Questions

Packaging compliance

We're a product manufacturer, not a packaging company. Do packaging rules apply to us?

+

Yes. Packaging obligations follow the company placing packaged goods on the market. If you sell products in packaging, the material, labeling, and producer rules for that packaging apply to you or to your importer in each market. Determining which is part of the obligation mapping.

What's changing under the EU Packaging and Packaging Waste Regulation?

+

A great deal, phased over several years: recyclability requirements for all packaging, recycled content minimums for plastics, restrictions on certain formats and substances, harmonized labeling, minimization rules, and reinforced producer responsibility. ORBIS tracks the phase-in against your packaging specifications through law impact analysis.

Can one recycling label work across markets?

+

Not reliably. Several countries mandate their own sorting labels, some prohibit symbols that imply a recyclability claim the local system doesn't support, and others require material codes in specific formats. ORBIS reviews packaging artwork against each target market so labels are compliant where they're used.

Every product ships in packaging. Every market regulates it.

Bring your packaging specifications, your volumes by market, and the registrations you hold. We'll map the material, labeling, and producer obligations and set up the program to run them.
